PropQuest.ai provides:

• Property search and analysis tools for real estate wholesalers and investors
• Skip tracing services to find property owner contact information
• Automated generation of Letters of Intent (LOIs) and purchase offers
• Campaign management for bulk document creation
• Gmail integration for sending LOIs and marketing emails to property owners
• Document tracking and campaign analytics

3. Gmail Integration and Email Services

3.1 Authorization

By connecting your Gmail account, you authorize PropQuest.ai to:

• Send emails on your behalf using Gmail's API
• Attach PDF documents (LOIs) to emails
• Track email delivery status

3.2 Your Responsibilities

When using email features, you agree to:

• Comply with the CAN-SPAM Act and all applicable email marketing laws
• Only send emails to recipients with whom you have a legitimate business purpose
• Include accurate sender information and subject lines
• Provide a clear way for recipients to opt out of future communications
• Not use the Service for spam, harassment, or fraudulent purposes
• Maintain your own unsubscribe list and honor opt-out requests

3.3 Email Limits and Fair Use

• Email sending is subject to Gmail's daily sending limits
• We may implement additional reasonable limits to prevent abuse
• Bulk sending features are for legitimate business communications only

4. Real Estate Compliance

You represent and warrant that:

• You are properly licensed if required in your jurisdiction for real estate activities
• Your use of the Service complies with all federal, state, and local real estate laws
• You will not engage in predatory or discriminatory practices
• All offers and LOIs you generate represent genuine intent to purchase
• You will honor the terms of any accepted LOI or purchase agreement
• You understand that LOIs generated may constitute legally binding offers in some jurisdictions

5. Account and Security

• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activities under your account
• You must be at least 18 years old to use the Service
• You agree to notify us immediately of any unauthorized access

6. Acceptable Use Policy

You agree NOT to:

• Use the Service for any illegal or fraudulent purpose
• Send unsolicited commercial emails (spam)
• Harass, threaten, or deceive property owners
• Misrepresent yourself, your intentions, or your affiliations
• Generate false or misleading offers
• Violate fair housing laws or engage in discrimination
• Scrape, copy, or redistribute our data without permission
• Attempt to breach or test our security systems
• Use the Service to compete with or harm PropQuest.ai
• Share your account with unauthorized users
• Use automated systems to abuse the Service

7. Payment Terms

• Subscription fees are billed monthly or annually in advance
• Skip tracing credits are pay-per-use and non-refundable
• All payments are processed through Stripe
• You authorize recurring billing for subscription services
• Refunds are provided only as required by law or at our discretion
• Price changes will be notified 30 days in advance

8. Data and Content

8.1 Your Content

• You retain ownership of content you create (campaigns, templates, custom fields)
• You grant us a license to use your content to provide the Service
• You are responsible for the accuracy and legality of your content

8.2 Property Data

• Property data is provided from third-party sources
• We do not guarantee the accuracy or completeness of property data
• You should independently verify all property information before making offers
• Skip trace data is for your use only and cannot be resold

9. Intellectual Property

All Service content, features, and functionality are owned by PropQuest.ai and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without explicit permission.

10. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We specifically disclaim:

• The accuracy or reliability of property data
• The deliverability of emails sent through Gmail
• The success of your real estate transactions
• Uninterrupted or error-free service
• The legality or enforceability of generated LOIs in your jurisdiction

11. Limitation of Liability

To the maximum extent permitted by law, PropQuest.ai shall not be liable for:

• Any indirect, incidental, or consequential damages
• Lost profits or failed real estate deals
• Damages from email delivery failures or Gmail service interruptions
• Actions taken based on property data or generated documents
• Third-party responses to your marketing campaigns

Our total liability shall not exceed the amount you paid us in the past 12 months.

12. Indemnification

You agree to indemnify and hold PropQuest.ai harmless from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your violation of any laws or regulations
• Your use of the email sending features
• Claims by property owners or email recipients
• Your real estate transactions or business practices
• Your content or campaigns

13. Termination

• You may cancel your account at any time through account settings
• We may suspend or terminate accounts for Terms violations
• Upon termination, your right to use the Service ceases immediately
• Gmail integration will be disconnected upon termination
• We may retain certain data as required by law

14. Governing Law
